Terms of Service

1. Who you are contracting with

These Terms of Service ("Terms") are a legal agreement between you and Shaheer Shahid Malik, operating as Econoglance ("Econoglance", "we", "us", "our"). By creating an account or otherwise using Econoglance (the "Service"), you agree to these Terms.

2. The Service

Econoglance is a SaaS platform that helps companies track, analyse, and optimise their software and AI spend. You must be of legal age and, if signing up on behalf of a company, have authority to bind that company.

3. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

You must not:

• Use the Service for any unlawful purpose or in violation of any law.
• Engage in fraud, spam, phishing, or abusive activity.
• Infringe intellectual property rights of any party.
• Interfere with the security or integrity of the Service, including by introducing malware, probing, scanning, or scraping without permission.

5. Licence and intellectual property

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan. We retain all rights, title, and interest in the Service, including software, documentation, and branding. You retain ownership of content you upload, and grant us a limited licence to host and process it solely to provide the Service.

6. Restrictions

You must not reverse engineer, resell, or redistribute the Service, or circumvent any technical limits.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency, renewal, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions automatically renew until cancelled.

9. Service availability

We do our best to keep the Service running, but we do not guarantee uninterrupted or error-free performance.

10. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to access the Service ends; you may export your data within 30 days after which it may be deleted.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, our aggregate liability under these Terms is capped at the fees you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where excluding it would be unlawful.

13. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

14. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated in-app or by email. Continued use after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which the seller is established, without regard to conflict-of-laws principles.
